1. Scope

Swiss Didgeridoo Artwork GmbH carries out the order according to the general terms and conditions valid at the time of the order. The terms and conditions are available on the website on a daily basis under the link terms and conditions. In case of doubt, the terms and conditions published on the website at the time of the order apply.

2. Conclusion of contract

The contract comes into being when we accept the contract offer made with your order through our order confirmation. This order confirmation contains the essential contents of your order.

3. Right of Withdrawal

The customer can cancel this contract within 3 days after the order has been received by the intended recipient, stating reasons, in writing and by returning the goods. Timely sending to the following address is sufficient to meet the deadline:

Excluded from this right of withdrawal are instruments, CDs and books, goods manufactured to customer specifications, goods specially procured for the customer, goods that are difficult to obtain and items that have arrived damaged.

We cannot guarantee that any particular product will perform as intended by you. Exchange is only possible in the case of incorrect deliveries or manufacturing defects. Exchange because you don't like it is excluded.

Please send returns with sufficient postage and enclose the original invoice. Returns sent free of postage will not be accepted. We expressly reserve the right to charge the customer for the additional costs incurred.

4. Delivery

Delivery is by post or by a courier service. The delivery time for goods in stock is usually 48 hours. If a title is missing, delivery can take a few days. We are entitled to make partial deliveries, which do not incur any additional costs, except for items that are difficult to obtain. In such cases, we will charge for the partial delivery of this item.

The costs of the consequences of transporting the ordered goods and their insurance are borne by the recipient. We will not insure the goods for transport without the customer's express written request.

In the event of damage during transport, a complaint must be made to the carrier and to us within 48 hours, otherwise the right to a replacement delivery is forfeited.

For shipments with a value of CHF 300 or more, we send the goods by registered mail. The resulting additional costs must be borne by the customer.

5. Didgeridoos

Didgeridoos and other oversized items will only be sent by post if expressly requested. We will be happy to take your order and reserve the item for possible collection. In addition to the delivery costs that appear on the electronic order confirmation, we charge a bulky goods surcharge of at least CHF 40.00.

6. Shipping Costs

You will usually receive an invoice in CHF for the items you have ordered. Delivery addresses abroad receive the invoice in euros. This is to be paid in advance.

The prices published in the shop do not include shipping costs. For domestic/abroad shipments please inquire about shipping costs.

7. Terms of Payment

Payments can be made in advance, cash on delivery or by invoice. For invoices (Switzerland only), we grant a payment period of 10 days.

  8. Default, dunning costs

For dunning costs incurred after the occurrence of default, we charge a flat-rate dunning fee of SFr. 15.- per reminder. We reserve the right to further claims, in particular with regard to the enforcement of the claim by a debt collection agency or the usual legal process.

  9. Warranty

In the case of the delivered goods, liability is limited to replacement delivery. Claims for cancellation of the contract or reduction of the remuneration are excluded if a replacement delivery is possible within a reasonable period of time. Objections due to defects in the goods can only be asserted within 8 days. If the inspection of the defective goods shows that the defects are due to culpable behavior on the part of the buyer (e.g. damage caused by improper handling), the buyer bears the costs of the replacement delivery.

10. Caveat

Our offer is non-binding. We reserve the right to deliver, errors and prior sale. The goods remain the property of "Swiss Didgeridoo Artwork" until full payment has been made.

Customer orders are subject to acceptance of these terms and conditions of delivery and business.

11. Retention of title, withdrawal

We retain title to the item ordered until all payments have been received  before. In the event of a delay in payment, we are entitled to withdraw from the contract and to reclaim the items ordered.

In the event that a supplier does not deliver the goods ordered despite a contractual obligation  can deliver and this leads to a not only temporary obstacle to performance through no fault of our own, Swiss Didgeridoo Artwork is entitled to withdraw from the contract. In the event of withdrawal, we will inform you immediately about the unavailability and reimburse you for services already rendered.

12. Refusal to accept:

In the event of unjustified refusal to accept the goods delivered by us, we will charge for the costs incurred. Our right to fulfillment of the purchase contract remains unaffected.

13. Governing Law and Jurisdiction

The provisions of Swiss law apply, even if the goods are ordered from or delivered abroad.

Place of jurisdiction for all claims in connection with your order is Miles ZH.

We are also entitled to sue at your general place of jurisdiction.

The ineffectiveness of individual provisions does not affect the remaining effectiveness of the contract and these General Terms and Conditions.
